INTELLECTUAL PROPERTY POLICY

Introduction

At Atacama Motorbike Tours SpA (the “Company”), we recognize the importance of protecting and respecting the intellectual and industrial property rights associated with our tourism services, digital content, and brand. This policy establishes the rules for the use, protection, and management of such rights, in compliance with Chilean law and applicable international treaties.

1. Protected Content â€‹

  • All content on the Company’s website, promotional materials, legal documents, and activities, including texts, images, logos, trademarks, videos, audio recordings, itineraries, designs, and databases, is the exclusive property of the Company or its respective owners, with whom license or authorization agreements are maintained.

2. Authorized Use â€‹

  • Clients and website users may access, view, download, and print content only for personal and non‑commercial use. 

  • Reproduction, distribution, public communication, modification, or commercial exploitation of the content without the Company’s prior written authorization is strictly prohibited. 

  • Any unauthorized use entitles the Company to take legal action under Chilean Law No. 17.336 on Intellectual Property and applicable international agreements.

3. Third‑Party Rights â€‹

  • Respect for third‑party intellectual property is an essential part of this policy. Any material or trademark used for illustrative, promotional, or reference purposes belongs to its respective owners. 

  • If a third party believes their rights have been infringed, they may submit their claim to info@atacamamotorbiketours.com

4. Licenses and Assignments â€‹

  • The Company may grant limited licenses to use certain content to business partners, travel agencies, media outlets, or others, with prior written authorization. 

  • Any assignment of rights will be formalized by contract and in accordance with applicable legislation.

5. Recordings During Tours â€‹

  • The Company may record video, audio, and/or photographs during tours for promotional, commercial, or archival purposes. 

  • Participation of the client in such recordings is optional and voluntary. Consent must be given in writing before, during, or after the tour, through a simple document provided by the Company. 

  • If the client does not grant consent, the Company will respect their decision and take measures to avoid their identification in the material. 

  • If consent is granted, the client authorizes the Company to use such images and recordings in digital media, social networks, promotional, and institutional material, without generating any additional financial compensation.

6. Updates and Validity 

  • ​The Company reserves the right to modify this policy at any time. 

  • The current version will be published on the official website and will take effect from the date of publication.
