MANDATORY INSURANCE AND LIABILITY DISCAIMER

Introduction

At Atacama Motorbike Tours SpA (the “Company”), client safety is a top priority. Since each person has different health conditions, needs, and interests —and may combine our services with other tours before or after— clients are required to purchase medical and/or travel insurance that fits their personal profile and the nature of the motorcycle adventure tourism activity.

1. Mandatory Nature of Insurance â€‹

  • Insurance is a mandatory requirement to participate in activities. Without a valid policy, the Company may exclude the client from the tour or purchase a standard insurance policy at the client’s cost, subject to availability. 

  • The insurance must cover, at a minimum: personal accidents, medical expenses (including evacuation), medical transport, repatriation, disability and death, and adventure tourism activities and off‑road motorcycle riding, depending on the tour selected with the Company. 

  •  The client must submit the certificate of coverage, valid for the entire duration of the tour, at least 14 calendar days in advance.

2. Recommended Insurance and Suitability for Client Profile â€‹

  • Each client is different: age, medical history, motorcycle experience, associated tours, and risk tolerance. For this reason, the Company recommends consulting their insurer/broker to select coverage and insured amounts that fit their personal situation. 

  • If the client plans additional activities (before/after the tour) or extensions (e.g., high‑altitude trekking, diving, etc.), we recommend explicitly including them in their policy.

3. Health and Fitness Declaration â€‹

  • The client declares that they are in adequate physical and psychological condition for the activity and undertakes to report any health changes prior to or during the tour. 

  • The Company may request medical certificates or evaluations when reasonable doubts exist; refusal entitles the Company to exclude the client under the cancellation policy.

4. Equipment and Safe Conduct â€‹

  • The use of helmet, boots, gloves, and technical protective gear is mandatory. The Company may deny participation if the equipment is insufficient. 

  • The client undertakes to ride in complete sobriety and to comply with safety instructions and applicable traffic regulations.

5. Liability Limits â€‹

  • The activity involves inherent risks associated with the natural environment and off‑road riding. The client participates voluntarily and assumes such risks. 

  • The Company shall not be liable for losses, damages, or injuries arising from fortuitous events or force majeure, acts or omissions of the client, or third parties beyond the Company’s control. Nothing herein limits the Company’s liability in cases of fraud or gross negligence. 

  • External providers (lodging, transportation, etc.) are responsible for their own services. The Company will act with due diligence in their selection and coordination.

6. Legal Basis and Safety Standards â€‹

  • This policy is issued under Chilean Law No. 19.496 (consumer rights protection, electronic contracting, and duty of information), Law No. 18.290 (traffic regulations regarding driving under the influence of alcohol or substances), and Chilean Adventure Tourism Standards, which include risk management, guide qualifications, and required insurance disclosures. 

  • The Company operates with safety protocols, backup satellite communication, and support vehicles, and may modify itineraries for safety reasons without this constituting a breach.

7. Procedure and Acceptance â€‹

  • Submission of the insurance certificate and signing of the Waiver/Disclaimer are essential parts of check‑in. 

  • By contracting, the client declares that they have read and accepted this policy, the Cancellation and Refund Policy, the Terms and Conditions, and the Complaints Policy.
